Selling Property

What is involved in a conveyancing transaction?
(What do we do for the money you pay us?)

If you are selling a property our role is as follows:

  1. We obtain the Deeds to the property and check the title.
  2. Ordering Office Copy Entries. These are copies of the entries that have been made at HM Land Registry. They provide details of all entries including the owners of the property and any charges.
  3. Preparation of the draft Contract. This document sets out the terms of sale and will be sent to your buyer’s solicitor for approval.
  4. Answering Preliminary Enquiries. We will be sent a number of enquiries by the purchaser’s solicitor about the property for things such as utility supplies and disputes over fences or boundaries which you will complete with our assistance.
  5. Preparation of engrossed contract. This is the final version of the contract which has been agreed by the parties.
  6. Signing the contract. The owners of the property will be required to sign the contract in readiness for exchange.
  7. Receiving the deposit and exchanging contracts. Because the exchange of contract is a binding agreement care must be taken to ensure that everything is in order before exchange takes place and where relevant the exchange of any property that you are buying also takes place with an agreed completion date.
  8. Sending evidence of title to the purchaser’s solicitor. Once exchange has taken place we will send a copy of the Deeds or the summary of their contacts, known as an Abstract of Title, to the purchaser’s solicitor.
  9. Discharges of mortgage. We obtain details from your lender, if there is still an outstanding mortgage, of the final amount to settle the mortgage upon the sale of the property.
  10. Arranging the signing of final documents. We will check that the transfer or conveyance is in accordance with the terms of the contract before you sign the final documents.
  11. Arranging completion. A date will be arranged and upon completion we will receive the balance of the purchase price and hand over the Title Deeds.
  12. Removal of charges. If there has been a mortgage or other charge over the property it will be necessary for us to pay off those charges and arrange for the charges to be removed from the title. We obtain a formal stamped document from your lender to confirm that the mortgage has been paid.

Slightly different procedures will be necessary if the title to the property is unregistered or if you are buying a leasehold property. We will give you a breakdown of the procedure in all cases of conveyance or transfer satisfactorily.
